Terms of Service Agreement
SING SEED (hereinafter referred to as the “Company”) provides you with the “FitCall AI” mobile application and related services (collectively referred to as the ‘Services’) pursuant to these Terms of Service (the “Agreement”). By accessing or using the Services, you agree to be bound by the terms and conditions of this Agreement. If you disagree with any part of this Agreement, please immediately cease using our Services.
I. Service Description
“FitCall AI” is a smart assistant application focused on fitness scenarios, dedicated to creating personalized and convenient fitness management and companion experiences for users. It helps users scientifically plan workouts and maintain consistent exercise habits.

Select Your AI Fitness Partner: Based on your exercise preferences, we intelligently match you with a dedicated AI fitness partner who provides tailored workout recommendations and companionship services.

Chat with Your AI Fitness Partner: Engage in real-time interactions with your AI companion—ask fitness questions, share workout experiences, and receive timely feedback.

AI Voice Call Reminders: Receive personalized workout reminders via AI voice calls. Customize alert times to avoid missing sessions and build consistent exercise habits.

Workout Calendar & Journal: Automatically sync and log your activity data (e.g., exercise type, duration, frequency) to generate a workout calendar. Easily review your progress and analyze results.
The company reserves the right to adjust service content based on business development, market demand, and technological innovation. For significant service changes, we will notify you promptly via prominent in-app announcements, email (if provided), or other appropriate means.
II. User Accounts
(A) Account Creation and Information Maintenance
When creating an account, you must provide accurate and complete information. You may choose to register via email or authorize login using a third-party account (e.g., Google, Apple ID).
If the company discovers that the information you provided is false, misleading, or incomplete, it reserves the right to suspend or terminate your account access and request that you supplement or correct the relevant information.
When registering an account, users must confirm that they meet the age requirements. Specific age restrictions will be displayed in the privacy agreement and app store labels.
(II) Account Security Responsibilities
You bear full responsibility for safeguarding your account credentials (such as passwords, verification codes, etc.). Please ensure your login information is securely set up and protected. Avoid using overly simple or easily guessed passwords, and change them regularly.
If you detect unauthorized activity on your account, immediately notify our customer service team via the in-app support channel or other contact methods provided.
(3) Account Operation Responsibility
You bear full legal responsibility and consequences for all actions performed through your account (including but not limited to setting exercise reminders, generating workout plans, adding exercise logs, interacting with AI companions, etc.).
The Company shall not be held directly liable for losses arising from account theft, password disclosure, or other circumstances attributable to your own actions.
(IV) Account Transfer Restrictions
You may not transfer, rent, or lend your account to any third party without the Company's written consent. If the Company discovers such violations, it reserves the right to immediately freeze or terminate your account and pursue your legal liability.
III. User Conduct Guidelines
When using the service, you must strictly adhere to the following conduct guidelines:

Compliance in Information Posting and Use: It is strictly prohibited to use the service to post or disseminate any illegal information, including but not limited to content that incites hatred or violence, information promoting terrorism or extremist ideology, and other information that violates national laws and regulations.

Legal Use of Service Features: Service features must not be used for any illegal purposes, such as harassing others via exercise reminders. You acknowledge that exercise recommendations and plans provided by the service are for reference only and do not constitute professional medical or fitness guidance.

Proper Technical Usage: Malicious acquisition of service content or interference with service operations through any technical means (e.g., web scraping, third-party software, hacking techniques) is prohibited.

Civilized Interaction and Usage: When using the service, maintain ethical standards and behavioral norms. Do not harass or abuse other users or support staff, and refrain from posting content that is harassing, insulting, or discriminatory.

Adherence to Exercise Health Principles: When using the services, you must follow scientific and healthy exercise principles. You may not use the services to advocate or engage in dangerous exercise behaviors. The company shall not be liable for any physical injuries resulting from your violation of healthy exercise principles.
IV. Payment and Fees
(A) Pricing and Validity Period
Pricing, validity periods, and specific service details for paid services (e.g., unlocking premium AI fitness companions) shall be subject to the information displayed on the service purchase page.
The validity period of paid services commences upon successful purchase and concludes at the expiration date specified on the service purchase page.
(II) Payment Methods and Confirmation
You may complete payment through official payment channels supported within the app (such as Apple Pay, Google Pay, etc., subject to actual availability).
Payment success is determined by the transaction record generated by the official payment channel. After completing the payment, we will activate the corresponding service permissions.
(3) Refund Policy
Refund eligibility and procedures will follow the policies of the official payment channels supported within the app (e.g., Apple Pay, Google Pay). If you meet the refund criteria, you must submit your request through the official payment channel.
(IV) Fee Dispute Resolution
If you have any objections regarding the payment details, you must raise them within 3 days of successful payment through the in-app customer service channel.
We will investigate and verify the matter within 7 business days of receiving your dispute and communicate the resolution outcome to you.
V. Intellectual Property
All content within the service, including but not limited to the design of the fitness AI companion, interactive text, software code, user interface (UI) design, and brand identifiers, are the intellectual property of the Company or its licensors.
You may only use the aforementioned intellectual property-protected content reasonably and within the scope necessary for service usage. Any unauthorized commercial use, technical infringement, or removal of identifiers is prohibited.
VI. Disclaimer
The exercise recommendations, AI companion interactions, and workout plan references provided through this service are intended solely as supplementary information. They do not constitute professional medical diagnosis, fitness instruction, or health advice.
Services are provided “as is.” The Company cannot guarantee uninterrupted or error-free service due to internet technology complexity, server maintenance, or other unforeseeable factors.
The Company shall not be liable for any failure to provide services caused by force majeure events (such as earthquakes, floods, typhoons, fires, wars, network outages, etc.).
VII. Limitation of Liability

Direct Loss Compensation: The Company's liability shall be limited to the actual service fees paid by you that are directly related to such loss.

Indirect Losses Exclusion: The Company shall not be liable for indirect losses, loss of anticipated benefits, or moral damages.

User Causation Exemption: The Company shall not be liable for losses incurred due to your violation of this Agreement or third-party infringements.
VIII. Indemnification
You agree to indemnify the Company and its employees, agents, and representatives against all losses, expenses, and liabilities arising from the following circumstances:
- Breach of Agreement Claims: Third-party claims against the Company due to your violation of this Agreement.
- Losses from Improper Conduct: Direct or indirect economic losses caused by your improper conduct during service use.
- Third-Party Account Disputes: Disputes or losses arising from your authorization of third parties to use your account.
IX. Governing Law and Jurisdiction
Any disputes arising from this Agreement shall first be resolved through friendly consultation between the parties. If consultation fails, either party may file a lawsuit with the competent court in the Company's place of business.
